A hidden technical issue, at the time of home selling transaction, that cannot be discovered by a prudent and diligent buyer, without specialized assistance, is the responsibility of the seller, who must disclose it.
According to the
law, as a home seller, you are obliged, at the time of the transaction, to
guarantee it against hidden vices (as well as against eviction).
The buyer who has
discovered a hidden technical issue of the house that existed prior to the
purchase can bring it to your attention within a reasonable, legally
established time. The designer, the certified project verifier specialist, the
manufacturers and suppliers of materials and products for construction, the
contractor, the specialist responsible for the authorized execution, the
authorized site supervisor or the certified technical expert may also be
legally liable, according to their obligations, for the hidden vices of the
construction, arising within the interval established by law, depending on the
nature of the technical issues.
If the buyer
discovers a hidden vice, he/she must immediately contact the seller. If there
is no response or reaction from them, the buyer may consider starting a court
action.
